Wake County Possession of Marijuana Drug Paraphernalia Dismissed
May 2021
Client was charged with possession of drug paraphernalia for an alleged marijuana grinder found during a traffic stop, as well as expired registration. Our North Carolina Criminal Defense Attorney spoke to the cop and established that he searched the car because he smelled marijuana. During further conversation, the officer eventually and reluctantly admitted that "marijuana" smells the same as hemp, and that he had no science based method to distinguish between illegal "marijuana" and legal industrial hemp. Faced with this serious hole in the criminal case, the district attorney made the logical and appropriate decision to dismiss the case (including the expired registration ticket).
