Our client's Wake County Shoplifting charge, with Walmart the alleged victim, was miscalendared, and necessary witnesses were not present. The defense was ready. The government sought a continuance, based upon a clerical error in scheduling the hearing. We objected to any further continuance, and pointed out reasons that the motion should be denied, including that the state had previously sought and received a continuance. The state's motion was denied, and the case was dismissed. Our client's charge of Resist, Delay, or Obstruct was also dismissed.
