Wake County Possession of Marijuana* Charge Dismissed

Weed charge dismissed. After we rejected an offer of deferral, we convinced the District Attorney that further attempt to prosecute our client for misdemeanor possession of marijuana would likely result in acquittal. Our argument, which has been thoroughly discussed on this website, was that the police officer, like everyone else (and dogs) can't distinguish between legal hemp and illegal cannabis products. Thus, without expensive and time-consuming testing by a private lab, the state is unable to prove that the substance possessed by my client was illegal.
