Larceny charge dismissed

After multiple court appearances, misdemeanor larceny charges were dismissed because necessary witnesses failed to appear in court. Frequently these charges, which are fairly serious "Class 1" misdemeanors, end up being dismissed if the correct loss prevention officer or other witness does not appear to testify regarding the factual basis of criminal allegations. Other times, these cases are overcharged as the more serious Larceny, when the factual basis would support a lesser "concealing merchandise" charge.
