Driving While License Revoke Charge Dismissed
April 2018
In North Carolina, a driver's license may be revoked for many different reasons. Recently, Raleigh Criminal Attorney Sean Cecil obtained dismissal of a "DWLR" case after helping a client resolve an old infraction for which the client had failed to appear, allowing the client to obtain reinstatement of his license to drive.
Generally, prosecutors in Wake County acknowledge the strong public policy in favor of having licensed drivers on the road and are willing to work with defendants to help them become eligible for a license. Sometimes this assistance takes the form of agreeing to multiple continuances; sometimes it is agreement to dismiss an old traffic ticket (usually those on the lesser end of the seriousness spectrum).
Knowledge of the local practices and the district attorneys is usually quite helpful in addressing these types of cases. Since the legislature reduced the seriousness of DWLR charges from a Class 1 to a Class 3 misdemeanor, defendants with very few prior convictions are unlikely to be eligible for assigned counsel and are left trying to navigate the system alone.
If you are facing a DWLR charge, an experienced local attorney can help by identifying obstacles to reinstatement, appearing in court on the client's behalf, and working with prosecutors to obtain the best possible outcome. Our fees for representation in such cases are moderate, and we offer free telephonic consultations.
