Felony Possession With Intent to Distribute Marijuana Charge Dismissed, Cash Returned

February 2025

Client was charged with a felony after a traffic stop revealed marijuana, a scale and baggies. On advice of counsel, client rejected prosecution's offer to plead guilty to a misdmeanor and accept probation. We filed a motion to suppress the evidence on the grounds of an unlawful traffic stop and unlawful search and seizure. Eventually the case landed on the desk of a prosecutor who realized the case was weak and we would not capitulate. The State dismissed the case, and we obtained an order requiring the return of the cash and phone seized during the arrest. Happy client!
