Felony Marijuana Charges resolved with Misdemeanor

Two felony marijuana charges were resolved with a misdemeanor plea to possession of over half an ounce of marijuana, a Class 1 misdemeanor under North Carolina law.  Six Ounces of marijuana and over $1000 in cash was discovered during a search after a traffic stop. After we unsuccessfully attempted to negotiate a misdemeanor, the client was indicted and the case sent to Superior Court. Our team filed a motion to suppress evidence discovered after the stop, on the basis that the stop was not supported by a reasonable suspicion that the client had committed a traffic violation, and that both the stop and the search were a violation of client's (black male) right to equal protection under the law. After a closer review of the case and evidence based on the issues raised in our motion to suppress, the District Attorney offered a favorable misdemeanor plea.
