Non-payment of bonus case settled

After a failed attempt to negotiate payment of a quarterly bonus owed to our client after she resigned from her employment, we filed a lawsuit in the Eastern District of North Carolina federal court alleging non-payment of wages and non-payment of overtime. Under the North Carolina Wage and Hour Act, an owed bonus is considered part of "wages". The federal Fair Labor Standards Act (FLSA) requires payment of at least minimum wage, and 1.5 times the hourly wage for every hour over 40 worked in a week. Although the former employer originally denied owing the bonus and overtime, after attorney Sean Cecil served discovery requests and made clear our willingness to try the case before a jury in federal court, an acceptable settlement was achieved.
